General Terms and Conditions

These General Terms and Conditions of WriteIt.ai s.r.o., ID No. 04518136, VAT No. CZ04518136, with its registered office at Na Folimance 2155/15, Vinohrady, 120 00 Prague 2, Czech Republic, File No. C 247717, registered with the Municipal Court in Prague (the “Provider”), govern the use of the CompassionHope service operated through compassion.ink (the “Service”) and any contract concluded between the Provider and a customer (the “Customer”).
Mandatory provisions of applicable Czech law and directly applicable European Union law remain unaffected by these Terms.
1. Agreement and Accounts
The contract is formed when the Customer creates an Account, purchases credits, or otherwise uses the Service. By doing so, the Customer accepts these Terms in full. The Customer must provide accurate Account information, keep their credentials confidential, and remain responsible for activity under their Account.
The Service is intended for users aged 18 years or older. The Customer represents that they have the legal capacity to enter into the contract under the law applicable to them.
The Customer may close their Account at any time through Account settings or by writing to support@compassion.ink. Closure terminates the contract for future use of the Service. Treatment of unused credits at closure is governed by Section 3.
2. The Service
CompassionHope generates artistic images displaying the word “compassion” (or its translation in a language selected by the Customer), composed of an AI-generated background, an AI-generated foreground, and the word rendered as vector cut-outs revealing the background through the letters.
Each generation produces two visual variants. The Customer selects which variant is published first to the Public Gallery. The variant chosen as primary is published immediately; the secondary variant is published after a delay (currently 24 hours), which may be adjusted by the Provider.
The Customer acknowledges and agrees that generated images may be displayed publicly in the Public Gallery on the Website. Publication does not include any personal information about the Customer beyond information voluntarily included in the image’s caption, if any. The Customer may request takedown of any image they generated by contacting support@compassion.ink; the Provider will action takedown requests within thirty (30) days.
The Provider may modify the available parameters, visual styles, and supported languages of the Service from time to time. The Provider commits to commercially reasonable efforts to keep the Service available but does not warrant uninterrupted or error-free operation.
3. Credits, Billing, and Refunds
The Service uses prepaid credits. One completed image generation consumes the number of credits displayed on the pricing page at the time of the generation. Credits are non-transferable.
Prices are displayed in the currency shown on the Website and include any applicable value added tax (VAT) where required by law for sales to consumers. Payments are processed by Stripe Payments Europe, Limited; the Provider does not store full payment-card details.
The Service may offer an opt-in auto-recharge feature: when the Customer’s credit balance falls below a threshold the Customer selects, the Provider automatically charges the Customer’s saved payment method for a recharge amount the Customer also selects. Auto-recharge requires the Customer’s express prior consent. The Customer may disable auto-recharge at any time through Account settings or by removing the saved payment method.
Right of withdrawal of consumers. Pursuant to § 1829 of the Czech Civil Code, a consumer ordinarily has a 14-day right to withdraw from a distance contract. By proceeding to generate images using purchased credits, the Customer who is a consumer expressly consents to immediate provision of digital content before expiry of that 14-day period and acknowledges that, by giving such consent, the right of withdrawal is excluded under § 1837 letter l) of the Civil Code with respect to credits that have been used to generate images.
Refund of unused credits. Notwithstanding the above, the Provider will, upon the Customer’s written request submitted within thirty (30) days of the credit purchase, refund the value of any unused credits held in the Account at the time of the request. The refund is paid to the original payment method. The Provider may deduct payment-processing fees that are not recoverable from the payment service provider.
Failed generation. If, due to a technical fault on the Provider’s side, an image generation fails to deliver a usable result, the Customer’s credits are restored automatically; if not, the Customer should contact support@compassion.ink.
Complaints (reklamace). Complaints regarding defective performance may be sent to support@compassion.ink. The Provider will acknowledge receipt without undue delay and resolve the complaint within thirty (30) days unless agreed otherwise. Rights arising from defective performance are governed primarily by §§ 1914–1925 and §§ 2099–2117 of the Civil Code, and, in the case of consumer contracts, by §§ 2161–2174b of the Civil Code.
4. AI-Generated Content
Images are generated through artificial-intelligence systems operated by third-party providers. The output is, by its nature, probabilistic and based on models trained on large datasets. The Provider does not warrant that any given image will be unique, original, or free of similarity to other works.
Customer license. Subject to the Customer’s compliance with these Terms and timely payment of all amounts due, the Provider grants the Customer a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, modify, and distribute images generated for them by the Service, including for personal and commercial purposes.
Provider license. The Customer grants the Provider a non-exclusive, worldwide, royalty-free license to display the image in the Public Gallery as described in Section 2 and to use the image for the operation, promotion, and marketing of the Service.
No warranty of originality. The Customer acknowledges that the underlying AI models may produce outputs resembling pre-existing works. The Provider makes no representation that any image is free of similarity to third-party works and disclaims all liability arising from such similarity, except where mandatory law provides otherwise.
5. Acceptable Use
The Customer must not use the Service in any manner that is unlawful, fraudulent, or that violates the rights of third parties; to circumvent technical, contractual, or rate-limiting controls applied by the Provider, including by automated means not authorized by the Provider; to resell, sublicense, or commercially redistribute the Service itself (as opposed to individual images, which are licensed to the Customer under Section 4); to attempt to reverse-engineer, copy, or derive the AI models or pipelines used by the Provider; or to disrupt the operation of the Website, the Service, or any infrastructure used by the Provider or its processors.
The Provider may suspend or terminate the Account of any Customer who breaches this Section, with or without prior notice depending on the severity of the breach.
6. Subprocessors and Third-Party Services
The Provider relies on third-party subprocessors including Stripe, Google Cloud Platform, OpenRouter, Cloudflare, and Brevo. Service availability may be affected by these providers. A current list of subprocessors, including countries of processing and the safeguards applied to international transfers, is set out in the Privacy Policy at compassion.ink/privacy.
7. Liability and Consumer Rights
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. The Provider does not warrant the fitness of any image for a particular purpose, its commercial value, or its uniqueness. AI-generated images may not always match expectations, and no warranty is given as to accuracy, language fidelity, or artistic quality.
To the maximum extent permitted by applicable law, the total aggregate liability of WriteIt.ai s.r.o. for any claim arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees the Customer paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) €500.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under mandatory law, including liability for gross negligence, wilful misconduct, fraud, death, or personal injury. Consumer-protection rights of consumers under Czech and EU law remain unaffected; where these Terms would conflict with such mandatory rules, the mandatory rules prevail.
8. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising from them are governed by the laws of the Czech Republic, without reference to conflict-of-law rules, and by directly applicable European Union law. Courts of the Czech Republic have jurisdiction unless mandatory law provides otherwise.
Out-of-court dispute resolution. A consumer has the right to seek out-of-court resolution of consumer disputes arising from the contract. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Štěpánská 567/15, 120 00 Praha 2, Czech Republic, web adr.coi.cz. The consumer may also use the EU online dispute-resolution platform at ec.europa.eu/consumers/odr.
Personal data. Detailed information about processing of personal data, including data-subject rights and the supervisory authority (Úřad pro ochranu osobních údajů), is set out in the Privacy Policy.

11. Changes to These Terms
The Provider may amend these Terms unilaterally for justified reasons, including changes in applicable law, changes in the Service, the addition of new features, or improvements in clarity or fairness. The Provider will notify the Customer of material changes by e-mail or in-app notice not less than thirty (30) days before the changes take effect. If the Customer does not agree with the changes, they may terminate the contract before the changes take effect by closing their Account.
